Welcome to The Wondring Himalaya, a travel agency specializing in curated tours to Spiti Valley and Kinnaur. By using our website (www.thewondringhimalaya.com) or booking our services, you agree to these Terms and Conditions. These terms govern your use of our services, including tour bookings, inquiries, and communications. Please read them carefully.
Booking Process
Bookings are initiated through forms on our website (e.g., Quick Booking, Custom Trip, Contact). Upon submission, your details are sent via WhatsApp to our team. A booking is confirmed only after:
- You receive a confirmation message from us via WhatsApp, email, or phone.
- A deposit (as specified in the booking confirmation) is paid.
We reserve the right to decline bookings at our discretion, with notice provided.
Payment Terms
A non-refundable deposit (typically 30% of the tour cost) is required to confirm your booking. The remaining balance must be paid at least 30 days before the tour start date, unless otherwise agreed. Payment methods and instructions will be provided upon booking confirmation. Late payments may result in cancellation of your booking without refund of the deposit.
Cancellation and Refunds
User Cancellations:
- More than 15 days before tour start date: 100% refund of the paid amount.
- 15 days or less before tour start date: 70% refund of the paid amount (30% will be deducted).
Company Cancellations: If we cancel a tour due to unforeseen circumstances (e.g., weather, safety concerns), you will receive a full refund or the option to reschedule. We are not liable for additional costs (e.g., travel, accommodation) incurred by you.
Refunds are processed within 14 business days via the original payment method.
User Responsibilities
You agree to:
- Provide accurate information during booking (e.g., name, contact details, travel preferences).
- Carry valid identification and permits (e.g., for restricted areas in Spiti).
- Ensure you are physically fit for the tour’s demands (e.g., high-altitude travel).
- Follow safety instructions and local laws during the tour.
- Respect local cultures, environments, and other participants.
Failure to comply may result in exclusion from the tour without refund.
Limitation of Liability
The Wondring Himalaya is not liable for:
- Loss, injury, or damage due to natural events (e.g., landslides, avalanches), political unrest, or other factors beyond our control.
- Services provided by third parties (e.g., hotels, transport), though we strive to partner with reputable providers.
- Personal expenses, missed flights, or other indirect costs.
Our liability is limited to the tour cost paid by you.
Changes to Itineraries
We may modify tour itineraries due to weather, road conditions, safety concerns, or other unforeseen events. We will notify you promptly and offer alternatives where possible. No refunds are provided for minor changes that do not significantly alter the tour’s value.
Third-Party Services
Our booking process uses WhatsApp for communication. WhatsApp’s terms and privacy policies apply to data sent via their platform. We are not responsible for third-party service failures or data handling.
Governing Law
These Terms and Conditions are governed by the laws of India. Any disputes will be resolved in the courts of Shimla, Himachal Pradesh, India.
Changes to These Terms
We may update these Terms and Conditions to reflect changes in our services or legal requirements. Updates will be posted on this page with a revised “Last Updated” date. Continued use of our services constitutes acceptance of the updated terms.
